Support Prof Tim Noakes in his quest to improve eating Guidelines

So far, the November 23 hearing against Noakes bears all the hallmarks of adversarial hearings favouring one party only, and it certainly isn’t Noakes.

When it comes to Strydom’s motivation, it can look like she is using ADSA to muzzle Noakes because he is affecting her and other dietitians’ business.

Or it could just be that she, ADSA and the HPCSA are proxies – witting or unwitting – for powerful vested interests that Noakes threatens. Among these are Big Food (especially the sugar industry), Big Pharma (especially drugs companies making billions from cholesterol-lowering drugs), medical doctors (especially cardiologists and endocrinologists wedded to the discredited diet-heart hypothesis) and medical and dietetic academics (who are increasingly seen as scientific dinosaurs for clinging to dogma).

All demonstrate varying levels of opposition and not just anger – but often incandescent rage – at Noakes for his views, despite the growing science showing that an LCHF diet safely and effectively treats obesity, diabetes and heart disease, to name but a few advantages for people of all ages.

In an earlier post, I made the point that Noakes could have made this all go away simply by deregistering as a medical doctor, thus removing the HPCSA’s jurisdiction over him. Noakes has explained in his own words, in another post on BizNews why he chooses to go ahead with this “trial”.

“I have been waiting years for this case. It’s not just about me and giving unconventional evidence and advice. It’s about why are South Africans so unhealthy? Why are we getting more obese and [why are more people being diagnosed with] diabetes?

“Is it the nutritional advice we are being given? That’s the question I am going to be addressing.”

‘It is a simple disease’

Diabetes and obesity are completely preventable, he maintained.

“It is said diabetes and obesity are complex diseases and we don’t understand it. That is nonsense. It is a simple disease. The biology is simple, as we will try to explain [during the hearing].”

“I don’t have to be here. I don’t practice medicine. I gave it up 15 years ago. But I believe that South Africans have to hear the truth. I have incurred enormous costs, but I believe so strongly that this message needs to get out. That’s why I am here.”

Cape Town – Professor Tim Noakes's legal team has accused the Health Professions Council of SA (HPCSA) of playing "fast and loose" with his rights.

"They are playing games with Professor Noakes's rights, constantly changing the position, leading us up one path and then alleging it's the wrong path," his lawyer Michael van der Nest said at his hearing on Monday.

This criticism came after it emerged at the hearing that they could be forced to approach a high court to get answers on why he was charged.

Van der Nest listed their failed attempts at getting reasons why a preliminary committee of inquiry decided to charge Noakes with unprofessional conduct.

He believed the preliminary committee had unduly involved itself in trying to find witnesses to testify against his client.

Noakes - whose book The Real Meal Revolution promotes a low-carbohydrate, high-fat (LCHF) lifestyle - was called before the council after a complaint was lodged by the former president of the Association for Dietetics in SA, Claire Julsing-Strydom.

The complaint centred on a tweet from Noakes to a mother who asked what foods she should feed her baby.

Noakes advised the mother to wean her child onto LCHF foods, which he described as real foods.

The tweet read: "Baby doesn't eat the dairy and cauliflower. Just very healthy high fat breast milk. Key is to ween [sic] baby onto LCHF."

Van der Nest said the HPCSA registrar had refused to answer their questions about the charge.

The registrar told him that the professional conduct committee was empowered to rule on this issue. He subsequently asked chairperson Joan Adams to make a ruling on Monday.

In response, the lawyer for the pro-forma complainant said that Noakes was entitled to these reasons, but that the appropriate forum was the high court.

"Nowhere in those regulations does it empower this committee to order the preliminary committee to divulge any of its deliberations or any of the decisions it has taken," said advocate Ajay Bhoopchand.

Van der Nest said the suggestion of approaching a court was "not only grossly unfair, but also surprising".

Adams postponed the hearing for deliberations until Tuesday morning.
